1. Policy Regarding Proof Images

Usage: Proof images are low-resolution and intended solely for display on the OneEyedFrog Photography® website.

Prohibited Actions: Downloading, copying, or taking screenshots of proof images or text is strictly prohibited and considered theft.

Usage Restrictions: Proof images are not allowed to be used on social media, websites, ads, or for third-party sponsors without authorization.

Unauthorized Use Penalty: A charge of $150 per photo will be applied and invoiced to the user for unauthorized use.

Account Consequences: Non-compliance may lead to the deauthorization of the user’s account until the outstanding invoice is paid in full.

2. Permission & Fees

Commercial use, including advertising or promoting a product or service, requires explicit permission and payment of fees. This includes using images for selling a horse or product or for any gain in sales. Third-party use is not permitted without written permission. 

Personal Use, used for personal, non-profit purposes, including posting on social media platforms with proper credit to OneEyedFrog Photography®.

3. Purchased Images

Watermark: Purchased images do not have "Proof" watermarks.

Usage Restrictions:  ALL Purchased images cannot be cropped, reproduced, copied, transmitted, manipulated, or used with third parties, on other websites, in sale ads, by graphic designers, photographers, artists, brand sponsors, magazines, newspapers, newsletters, clubs, or for advertising without explicit written permission.

Photo Credit: Any reproduction of purchased images in any medium must include a photo credit to OneEyedFrog Photography.

4. Personal Use

Allowed Uses: Purchased images may be used for personal, non-profit purposes, including posting on social media platforms with proper credit to OneEyedFrog Photography®.

High-Resolution Images: Permitted for personal use on social media, personal websites, and printing up to A2 size. Editorial usage must include a credit line acknowledging OneEyedFrog Photography or www.oneeyedfrog.com.au as the photograph's author.

Low Resolution / Social Media: Social Media posts should use hashtags to credit OneEyedFrog Photography.

5. VEIS Schools Use

Use Guidelines: Images can be used for school websites, newsletters, and personal use with proper credit to OneEyedFrog Photography®. Purchased images must not be cropped, reproduced, copied, transmitted, manipulated, or used with third parties.

6. Order Processing

Processing Time: Orders placed after 7 pm are processed the next business morning after 10 am. Digital images are typically delivered within 48 to 72 hours, although weekend orders are processed on business days.

Image Preparation: All images undergo color correction and straightening before delivery.

Production Time: Montages, frames, and prints may take up to a week to organize, with large orders potentially taking up to 6 weeks. Print orders are completed during business hours. Fine art image editing for equine images is available at an hourly rate and may require several days to complete.

7. Delivery

Shipping: Products are shipped via Australia Post or a courier service. Customers must provide a delivery address where someone is available to receive the items. If delivery is not possible due to unavailability, customers must arrange alternative delivery with the post office or courier company.

8. Payment

Methods: Payments can be made via credit card, PayPal, cash, direct deposit, or payment plans.  Products and pricing are subject to change at any time. Orders may be limited or canceled based on customer account status, credit card information, or billing/shipping address.

9. Accuracy of Information

Corrections: The website may contain typographical errors, inaccuracies, or omissions related to promotions and offers. Corrections can be made at any time without prior notice. The website has no obligation to update, amend, or clarify information, including pricing, except as required by law.

10. Links to Other Resources

No Implicit Approval: Links to other resources do not imply approval, association, sponsorship, endorsement, or affiliation unless explicitly stated. OneEyedFrog Photography is not responsible for the actions, products, services, or content of third parties.

11. Intellectual Property Rights

Trademark and Copyright: OneEyedFrog Photography is a worldwide registered and protected IP trademark owned by Sharlene Phillips. Intellectual property rights include all present and future rights in relation to copyright, trademarks, designs, patents, inventions, goodwill, and other intellectual property rights. This agreement does not transfer any intellectual property owned by OneEyedFrog Photography or third parties to the user.

12. Changes and Amendments

Modifications: The agreement may be modified at any time, with changes effective upon posting on the website. Continued use of the website and services constitutes consent to such changes.

13. Acceptance of Terms

User Agreement: By accessing and using the website and services, users agree to be bound by the terms of this agreement. If users do not agree to abide by these terms, they are not authorized to access or use the website and services.
